A response to Bayer's movement for judgment on the pleadings on all of the plaintiff’s claims based primarily on the issue of preemption was filed by Koch Parafinczuk & Wolf on Monday, June 1st, 2015. The law firm out of Fort Lauderdale Florida explained why claimants injured by Essure should indeed be able to seek compensation for their injuries despite its preemptive status . UPDATE: On June 30, 2015 Bayer filed it's reply in the United States District Court for the Eastern District of Pennsylvania. A response from the judge is now anticipated as to whether or not the case will move forward. To read the full motion click on the tab labeled Bayer Response.
